District Court Judges Decision

Wisconsin Judge Declines Gov. Evers' Request to Revise Youth Prison Consent Decree

District Court Judge's Decision

District Court Judge James Peterson has denied Governor Tony Evers' request to revise a consent decree governing the Lincoln Hills School for Boys and Copper Lake School for Girls youth prisons.

Evers' Request

In a letter to Judge Peterson, Governor Evers argued that the consent decree, which was put in place in 2018 to address concerns about safety and abuse at the prisons, no longer reflects the current conditions at the facilities.

Judge's Rationale

Judge Peterson, however, ruled that the consent decree remains necessary to ensure the safety and well-being of the youth in the prisons.

Republican Response

Governor Evers' request was supported by Republicans, including State Senator Van Wanggaard and U.S. Representative Bryan Steil. They argued that the consent decree was too restrictive and prevented the prisons from operating effectively.

Democratic Response

Democrats, including Governor Evers and Attorney General Josh Kaul, argued that the consent decree was essential to protect the youth in the prisons. They cited evidence of ongoing safety and abuse concerns at the facilities.

Next Steps

The Wisconsin Department of Corrections has stated that it will continue to work with Judge Peterson to ensure compliance with the consent decree.
